False Statement in Police report about evidence.?

I had a verbal fight with one of my friend, and then there were some phone calls and text messages that I sent, but only on the day of fight. After that there was no contact.





After some days she filed a police report that I was stalking her. The officer said in his report that I have been sending her messages for the past 4 days. I can prove it from my phone report that I never contacted her after that day.





Isn't it a false statement by police officer. Isn't it enough to put his credibility at stake and that of the report?False Statement in Police report about evidence.?

this does not say for the last 4 days. it says within the last 4 days. that means 4 days ago, there is no contradiction between what you admit and what you quote the report as saying.False Statement in Police report about evidence.?
showing the evidence in court should be enough to have a judge question the officers report,but a judge will not admonish the officer. if the issue was more drastic i would hire an attorney and get a foia and dump records for at least 4 months. remember that you could also be accused of not using your own phone.
He's reporting what SHE said.

If you sent messages 4 days ago, that would be ';within the last 4 days';. I doubt this was meant to intentionally deceive, it is probably what she is telling him.





All it takes is 1 message that is harassing, intimidating, or threatening to be illegal.





This is your 4th post on this question, you need to talk to an attorney instead of trusting strangers with legal advice.
If this goes to court you will prove that you did not call her by bringing phone records. This will be all the proof the judge needs and she will be in trouble for false reporting not the officer he was only repeating what he was told by your ex-friend. If it goes to court and you have to hire an attorney I would sue her for all of your legal fees and liable.
Nope. He is not making an opinion. He is reporting what the girl told him about you. Actually, if she waited a couple days before calling the police then one of two things happened. One- she talked with friends and family and they told her to do it after reading your messages. Basically, protecting herself from any threat you may or may not have said. Or two- She wants to report it because although you texted her 4 days ago you may still have had some kind of contact with her.





If you were arrested, bring your phone bill to court as evidence.





As far as going after the police officer that wrote the report, he was just reporting what was reported to him. He is not making up the story. Your beef is not with the police, it's with the girl who called them.
He is only writing down her statement, not his. He has nothing else to go on. Just like when someone gets robbed, they get the description from the person who was robbed to track him down. If they say it was a man with brown hair, that is who they are going to look for, but the person who was robbed could have been lying, maybe he was robbed by a blond woman. It doesn't matter what he reports. It doesn't go on your record, and if you end up going to court (harassment) all you would have to do is show them your phone bill and she instantly looses credibility. I wouldn't even worry about it since harassment casses aren't that common among middle class between people, but rather by domestic (married or divorced) couples. Don't worry about it, try not to get too angry that she is lying about the situation, and just try and ignore her...she's obviously a liar anyway.
